Welcome to Elope, your subscription-based airline ticket service. By accessing or using our website located at www.elope.co.uk (the “Website”), you agree to comply with and be bound by these Terms and Conditions (“Terms”). Please read these Terms carefully. If you do not agree to these Terms, you must not use our services.

By subscribing to Elope’s services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference into these Terms. If you do not agree with any part of these Terms, you must not subscribe or use our Services.

Definitions

In these Terms, the following definitions apply:

  • “Elope,” “we,” “us,” or “our” refers to Elope Ltd, a company registered in England and Wales with company number 14773994.
  • “Subscriber” or “you” refers to any individual or entity that subscribes to our services.
  • “Services” refers to the subscription-based airline ticket services provided by Elope, including the management and redemption of Elope miles.
  • “Subscription Agreement” refers to the agreement between Elope and the Subscriber, which includes these Terms.
  • “Elope miles” refers to the points earned through our subscription plans, which can be used for flight bookings.
  • “Website” refers to our online platform located at www.elope.co.uk.

Acceptance of Terms

    1. Account Registration: To access certain features of the Services, the Subscriber must create an account (“Account”) on the Website. By creating an Account, the Subscriber confirms that all information provided during the registration process is accurate, current, and complete. The Subscriber agrees to promptly update any information provided to Elope to ensure it remains accurate, current, and complete. Elope reserves the right to suspend or terminate any Account that it believes to be inaccurate, incomplete, or in violation of these Terms.
    2. Account Security: The Subscriber is solely responsible for maintaining the confidentiality of their Account credentials, including their username and password, and for all activities that occur under their Account. The Subscriber agrees to take all reasonable measures to protect their Account information from unauthorised access. The Subscriber must notify Elope immediately if they become aware of any unauthorised use of their Account or any other breach of security. Elope will not be liable for any loss or damage arising from the Subscriber’s failure to comply with this obligation.
    3. Account Usage: The Subscriber agrees to use their Account solely for personal, non-commercial purposes and in compliance with all applicable laws and regulations. The Subscriber shall not permit any third party to use their Account or access the Services on their behalf. Elope reserves the right to investigate any unauthorised use of an Account and may take appropriate action, including suspension or termination of the Account.
    4. Account Termination: Elope reserves the right to suspend or terminate any Account at its sole discretion, without prior notice, for any reason, including but not limited to:
  • Violation of these Terms;
  • Fraudulent, abusive, or illegal activity;
  • Failure to pay subscription fees or other charges; or
  • Failure to respond to communications from Elope regarding the Subscriber’s Account.

Upon termination of an Account, the Subscriber will lose access to all Elope miles and benefits associated with the Account. Any unused Elope miles will be forfeited unless otherwise specified in these Terms.

  1. No Transfer of Account: The Subscriber’s Account is personal to them and may not be transferred or assigned to any other individual or entity. Elope will not recognise any attempt to transfer an Account to another person.

Eligibility

      1. Age Requirement: You must be at least 18 years of age at the time of creating your Account and subscribing to our Services. By using the Website and our Services, you represent and warrant that you are at least 18 years old. If you are under 18 years of age, you are prohibited from using our Services and must refrain from creating an Account. In the event that we become aware that an individual under the age of 18 has provided us with personal information or created an Account, we will take appropriate steps to delete such information and terminate the individual’s access to our Services.
      2. Legal Capacity to Enter into a Contract: By subscribing to Elope’s Services, you affirm that you possess the legal capacity to enter into a binding contract under applicable law. This means you have the mental capacity to understand the terms and consequences of this Agreement and to make an informed decision regarding your subscription. If you are acting on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms and that such entity agrees to be bound by the terms contained herein. Should you lack the legal capacity to enter into this Agreement—due to age, mental incapacity, or any other reason—you must refrain from using our Services. Elope shall not be liable for any claims or disputes arising from unauthorised use of our Services by individuals who do not meet these eligibility requirements.
      3. Verification of Eligibility: Elope reserves the right to verify the age and legal capacity of Subscribers through any reasonable means, including requesting identification or other relevant documentation. If you are unable to provide satisfactory proof of age or legal capacity, Elope may terminate your subscription and access to the Services immediately. By continuing to use our Services, you agree to cooperate with any such verification processes and acknowledge that failure to do so may result in the suspension or termination of your Account.

Subscription Plans

      1. Elope offers various subscription plans as detailed in the Subscription Agreement. The Subscriber agrees to choose a plan and pay the applicable fees as outlined during the subscription process.
        1. Free Package: The Free Package allows users to experience Elope’s services without any financial commitment. This package is ideal for those who want to explore the benefits of the platform before committing to a paid plan.
        2. Bronze Package: The Bronze Package is designed for occasional travellers who seek more benefits than the Free Package provides, allowing them to accumulate Elope miles and enjoy more flight options.
        3. Silver Package: The Silver Package caters to regular travellers who want more flexibility and options when booking flights and using their Elope miles.
        4. Gold Package: The Gold Package is designed for frequent travellers and businesses seeking the ultimate benefits and flexibility when using Elope’s services.

The Subscription Agreement provides detailed descriptions of each plan, including any applicable terms and conditions, ensuring that you have a comprehensive understanding of what each package entails before making your selection.

Payment and Billing

      1. Payment Terms: Subscription fees will be billed monthly in advance. The Subscriber agrees to provide valid payment information and authorises Elope to charge the applicable fees on a recurring basis. If the payment method fails or is declined, Elope reserves the right to suspend or terminate the Subscriber’s access to the Services until payment is received. Kindly refer to the Subscription Agreement for more information.
      2. Refund Policy: Subscribers may cancel their subscription within 14 days of the initial purchase for a full refund, provided that no Elope miles have been used, gifted, or shared. After the 14-day period, no refunds will be issued. Kindly refer to our Cancellation and Refund Policy for more. 

User Obligations

    1. As a Subscriber, you agree to the following obligations when using Elope’s services:
  • Compliance with Laws: You shall comply with all applicable laws, regulations, and guidelines related to your use of the Services, including but not limited to laws regarding the purchase and use of airline tickets and the redemption of Elope miles.
  • Accurate Information: You shall provide accurate, current, and complete information when creating an Account or engaging with the Services. You agree to update such information promptly to ensure its accuracy.
  • Responsible Use: You agree to use the Services only for lawful purposes and in a manner that does not infringe upon the rights of Elope or any third parties. This includes refraining from using the Services to engage in any fraudulent, misleading, or deceptive practices.
  • Account Security: You are responsible for maintaining the confidentiality of your Account credentials and for all activities that occur under your Account. You shall notify Elope immediately of any unauthorised use of your Account or any other breach of security.
  • Use of Elope Miles: You agree to use your Elope miles only in accordance with the terms set forth in this Agreement. You shall not engage in any activities that may constitute a misuse of Elope miles, such as selling, transferring, or sharing miles in a manner not permitted by Elope.
  • Feedback and Communication: You agree to provide accurate and constructive feedback regarding your experience with Elope’s Services. Additionally, you shall respond promptly to any communications from Elope regarding your Account or the Services.
  • Prohibited Activities: You shall not engage in any conduct that disrupts or interferes with the Services, including but not limited to:
    • Attempting to gain unauthorised access to any part of the Services or any other systems or networks connected to the Services.
    • Introducing viruses, trojan horses, worms, or other harmful code to the Services.
    • Using any automated means, including bots, spiders, or scrapers, to access the Services for any purpose without Elope’s express written permission.
  • Responsibility for Minors: If you permit any minor to use the Services under your Account, you are fully responsible for their actions and any consequences thereof. You agree to supervise their usage to ensure compliance with these Terms.
  • Reporting Violations: You agree to promptly report any violations of these obligations or any suspicious activity related to your Account or the Services to Elope.
  1. By fulfilling these obligations, you contribute to a positive and secure experience for yourself and other users of Elope’s Services.

Information on the Website

      1. Accuracy of Information: Elope strives to provide accurate, up-to-date, and comprehensive information on the Website concerning the Services, subscription plans, Elope miles, and any other relevant content. However, Elope makes no representations or warranties, express or implied, regarding the accuracy, completeness, or reliability of any information available on the Website.
      2. No Guarantee of Availability: The information, features, and services described on the Website are subject to change at any time without notice. Elope does not guarantee the availability of any specific services or features and reserves the right to modify, suspend, or discontinue any part of the Services at its discretion.
      3. External Links: The Website may contain links to third-party websites or resources for your convenience. Elope is not responsible for the content, availability, or accuracy of any third-party sites linked from the Website. The inclusion of any link does not imply endorsement by Elope of the linked site or any association with its operators. You are encouraged to review the terms of service and privacy policies of any third-party websites you visit.
      4. User Responsibility: While Elope makes every effort to ensure that the information on the Website is accurate and current, you acknowledge that it is your responsibility to verify the information before relying on it. Elope shall not be liable for any errors, inaccuracies, or omissions in the information provided on the Website or for any decisions made based on such information.

Acceptable Use Policy

    1. General Use: By accessing and using Elope’s Services, you agree to adhere to this Acceptable Use Policy. You are solely responsible for ensuring that your use of the Services complies with all applicable laws and regulations, as well as the terms set forth in this Agreement.
    2. Prohibited Conduct: You agree not to engage in any of the following prohibited activities:
  • Illegal Activities: Using the Services for any illegal or unlawful purpose, or in a manner that violates any applicable local, national, or international law or regulation.
  • Harassment and Abuse: Engaging in any form of harassment, abuse, or threatening behaviour towards any other user or third party, including but not limited to sending unwanted messages, spam, or other forms of disruptive communication.
  • Impersonation: Impersonating any person or entity, or falsely stating or misrepresenting your affiliation with any person or entity.
  • Disruption of Services: Attempting to disrupt, interfere with, or gain unauthorised access to the Services, servers, or networks connected to the Services, including through the use of viruses, malware, or other harmful code.
  • Misuse of Elope Miles: Engaging in any activity that constitutes a misuse of Elope miles, including but not limited to selling, transferring, or sharing miles in a manner not expressly permitted by Elope.
  • Automated Access: Using any automated system, including robots, spiders, or offline readers, to access the Services in a manner that sends more request messages to Elope’s servers than a human can reasonably produce in the same period of time.
  • Content Restrictions: Uploading, posting, or otherwise transmitting any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable, or that infringes upon the intellectual property rights of any third party.
  1. Monitoring and Enforcement: Elope reserves the right, but not the obligation, to monitor any user activity and to investigate any violations of this Acceptable Use Policy. Elope may take any action it deems appropriate, including but not limited to warning users, suspending or terminating Accounts, or reporting any suspected illegal activity to law enforcement authorities.
  2. Reporting Violations: If you become aware of any violation of this Acceptable Use Policy or have concerns regarding the behaviour of any user, you are encouraged to report it to Elope immediately by contacting customer support.
  3. Consequences of Violation: Any violation of this Acceptable Use Policy may result in the immediate suspension or termination of your Account and access to the Services, as well as potential legal action, at Elope’s discretion.

 

Intellectual Property

  • Ownership of Intellectual Property: All content, materials, trademarks, service marks, logos, designs, graphics, text, software, databases, and any other elements available on the Elope website and through its Services (collectively referred to as “Intellectual Property”) are either the property of Elope, its licensors, or third-party providers, and are protected by UK copyright, trademark, and other intellectual property laws. This includes but is not limited to all technology, software, website content, promotional material, images, audio, and video content, databases, and any other elements made available by Elope.
    1. Limited Licence for Use: Elope grants you a limited, non-exclusive, non-transferable, revocable licence to access and use its Intellectual Property solely for the purpose of interacting with and utilising the Services for personal, non-commercial use in accordance with this Agreement. This licence does not transfer any ownership rights to you. You may not use Elope’s Intellectual Property for any commercial purpose, nor may you modify, reproduce, distribute, display, or perform any of the content without Elope’s express written permission.
    2. Third-Party Intellectual Property: Certain elements of the Services may include content that is owned by third-party licensors. Elope has no control over, and assumes no responsibility for, third-party intellectual property rights. Your use of third-party content is subject to the applicable third-party’s terms and conditions, which may be enforced directly by the third party.
    3. User-Generated Content: By submitting any content (including but not limited to text, images, video, and other media) to Elope, you grant Elope a non-exclusive, royalty-free, perpetual, worldwide licence to use, reproduce, modify, adapt, publish, translate, distribute, and display that content on the Services. You warrant that any content you submit is original, does not infringe upon the rights of any third party, and complies with all applicable laws and regulations. You are solely responsible for ensuring that your content does not violate any intellectual property rights of others.
    4. Reporting Intellectual Property Violations: If you believe that any content on Elope’s Services infringes your intellectual property rights, please contact us immediately at contactus@elope.co.uk with the following information:
  • A description of the intellectual property that you believe is being infringed;
  • Sufficient information to locate the allegedly infringing content;
  • A statement affirming that you have a good-faith belief that the use of the content is not authorised by the intellectual property owner, its agent, or the law;
  • A statement affirming that the information you provide is accurate and that you are the owner or authorised to act on behalf of the intellectual property owner.

Limitation of Liability

    1. General Limitation of Liability: To the fullest extent permitted by law, Elope shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of, or inability to use, the Services, including but not limited to:
  • Loss of profits, revenue, or business opportunities;
  • Loss of data or goodwill;
  • Personal injury or property damage;
  • Any unauthorised access to or use of Elope’s secure servers and/or any personal information stored therein;
  • Any interruption or cessation of transmission to or from the Services;
  • Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Services by any third party; or
  • Any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via the Services, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not Elope has been advised of the possibility of such damage.
  1. Exclusions: Nothing in this Agreement shall limit or exclude Elope’s liability for:
  • Death or personal injury caused by Elope’s negligence;
  • Fraud or fraudulent misrepresentation;
  • Any other liability that cannot be limited or excluded by law.
  1. Maximum Liability: Subject to Clause 10.2, the maximum liability of Elope to you for any claim arising out of or relating to the Services shall be limited to the total fees paid by you for the Services during the 12 months preceding the event giving rise to the liability. 

 

Dispute Resolution

  • Governing Law: These Terms shall be governed by and construed in accordance with the laws of England and Wales.
      1. Dispute Resolution Process: In the event of any dispute, controversy, or claim arising out of or relating to these Terms or the Services, the parties shall first attempt to resolve the dispute through negotiation in good faith. If the dispute cannot be resolved amicably within 30 days, either party may refer the matter to mediation or, if necessary, to the courts of England and Wales.

Privacy Policy

The use of personal data and information is governed by our Privacy Policy, which is incorporated into these Terms. By using our Services, you consent to the collection and use of your information as described in our Privacy Policy.

Changes to Terms

Elope reserves the right to amend or update these Terms at any time. Any changes will be posted on the Website, and continued use of the Services after such changes constitutes acceptance of the updated Terms. Subscribers will be notified of significant changes via email.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.

Waiver

No waiver by Elope of any breach of these Terms shall constitute a waiver of any prior or subsequent breach. Any failure by Elope to enforce any right or provision under these Terms shall not constitute a waiver of such right or provision.

Assignment

Elope may assign or transfer its rights and obligations under these Terms without notice to the Subscriber. The Subscriber may not assign or transfer their rights or obligations under these Terms without the prior written consent of Elope.
